Gray, The Surety & Fidelity Association of America (SFAA) President Lynn Schubert, Department of Small and Local Business Development (DSLBD) Director Harold Pettigrew, and District Department of Transportation (DDOT) Director Terry Bellamy today announced the launch of the “Bond Your Business: Road Map to Success” Bonding Program, a new partnership designed to increase the competitiveness of District-based small businesses through bond readiness training.

 

“The District’s economy is fueled by small businesses and this partnership exemplifies our shared commitment to ensuring that our business community is offered the best available resources to lay a strong foundation and improve their capacity to grow and compete,” said Mayor Vincent C. Gray. “SFAA has been a recognized leader in the surety industry and we are very fortunate to have their expertise.” 

 

The “Bond Your Business” Initiative is developed from the SFAA’s Model Contractor Development Program® (MCDP), a series of workshops designed to educate small and emerging contractors on improving their bonding capacity.  The program will provide small businesses with assistance for qualifying in the surety market and gaining access to surety credit.  Bonding readiness helps small businesses secure surety bonds for construction projects, and includes workshops on accounting and financial management, insurance requirements, safety management, credit repair, cost estimating, and more. 

 

“DSLBD is committed to helping Certified Business Enterprises with competing for and winning work in the District,” said DSLBD Director, Harold Pettigrew. “It is critical for small businesses to access the capital they need and the bonding to compete on the many construction projects underway across our city.  Helping firms to navigate the process of becoming bond ready will further alleviate one of the biggest challenges facing small contractors.  The ‘Bond Your Business’ initiative will ensure that our firms are equipped with the tools necessary to be successful and help to further strengthen the District’s local economy.”

 

“The Surety & Fidelity Association of America is pleased to enter into this Agreement, which formalizes our ongoing efforts with the District of Columbia to make bonding more accessible to DC-based contractors,” said SFAA President Lynn Schubert.  “For the past several years, our Model Contractor Development Program® successfully has been implemented throughout the country, including in D.C., and these initiatives have resulted in more than $400 million in bonding to small and emerging contractors.  We are excited about our partnership with the DC Department of Small and Local Business Development and the District Department of Transportation and look forward to continued success under this Program.”

 

“Bond Your Business” consists of seven highly interactive classroom workshops that will provide a range of information related to improving the company’s operations.  Each workshop features presentations by professionals in the field, and will consist of one-on-one interactions between business owners and surety bond producers and underwriters, during which they address issues in the application process that could pose challenges to the underwriting of a bond for small businesses.  DSLBD’s program will launch in March 2013, with a complimentary program administered by DDOT in the fall of 2013 for small businesses focused on construction opportunities in the transportation sector.

Subcontractors Celebrate Victory Limiting Risk-Shifting in Minnesota
ASA Asked Minnesota Supreme Court to Uphold State’s Anti-Indemnity Law

ALEXANDRIA, Va. — In a major victory sought by the American Subcontractors Association on behalf of Minnesota’s subcontractors, the state’s Supreme Court has affirmed limits on risk-shifting based on the state’s anti-indemnity law (Minn. Stat. §337.02).

On Jan. 23, 2013, the Supreme Court of Minnesota reversed an appeals court’s decision that allowed a general contractor to shift liability to a subcontractor for damage caused by a general contractor’s own direction of the subcontractor’s work. “Because we conclude that ECI did not qualify as an additional insured with respect to the pipe damage and that Bolduc cannot be required to indemnify ECI without violating Minn. Stat. §337.02, we reverse,” the high court wrote in its opinion, reversing the appeals court’s decision in Engineering & Construction Innovations, Inc., v. L.H. Bolduc Co., Inc.

In an amicus curiae brief filed on Jan. 13, 2012, ASA urged the Minnesota Supreme Court to overturn the appeals court’s decision and protect construction firms from being forced to pay for damage for which others on construction projects are at fault. “The Court of Appeals erred in its interpretation of the indemnity clause in the ECI/Bolduc subcontract,” ASA wrote. “This Court should correct this error by holding ... that the Bolduc/ECI indemnity clause did not include ECI’s own fault or negligence, but only extended to the fault or negligence of Bolduc for which ECI may be liable.”

L.H. Bolduc was a subcontractor on a sewer and water project. During the construction process, the sewer pipeline suffered damage at the direction of the general contractor. The general contractor repaired the pipeline and then sought reimbursement from the subcontractor and the subcontractor’s insurance company. Both refused.

At trial, a jury sided with the subcontractor, saying the subcontractor was not negligent. After the verdict, a district court also found that the subcontractor was not required to indemnify the general contractor from damages the general contractor suffered due to its own negligence and that the insurer similarly did not agree to provide insurance against anything other than claims arising from the subcontractor’s work or negligence. But on appeal, a court issued a split decision, holding that the subcontract’s indemnity clause required the subcontractor to “both indemnify for another’s negligence and insure that risk.”

The dissenting judge in the case noted that Minnesota’s anti-indemnity statute prohibits the subcontractor from indemnifying the general contractor for its own negligence and concluded that the subcontract did not clearly and unambiguously require that the subcontractor indemnify and insure the general contractor for the general contractor’s negligence.

ASA noted in its brief that Minnesota state legislators and courts enacted the state’s anti-indemnity statute specifically to curtail risk-shifting and make parties responsible for their own — not others’ — mistakes: “The legislative history of Minn. Stat. §337.02 reflects the Legislature’s determination that the prohibition of such broad form indemnity clauses would lead to greater safety in the workplace. The anti-indemnity statute also recognizes the imbalance in bargaining power that exists between contractors and subcontractors, which leads to unfair subcontract terms, including broad form indemnity … Thus, there is a strong public policy, emanating from both case and statutory law, in favor of making each participant in a construction project responsible for its own negligence or fault.”

ASA’s Subcontractors Legal Defense Fund (www.sldf.net) financed the brief in this case.

ASA Honors Concrete Services Corporation’s Cris Gillmore with National Award for Outstanding Service

SAN ANTONIO, Texas — The American Subcontractors Association honored Cris Gillmore, Concrete Services Corporation, Tulsa, Okla., with an Outstanding Service Award. Gillmore accepted the award on March 2 during ASA’s annual meeting in conjunction with the ASA Business Forum and Convention 2012 in San Antonio.

“Many, if not most, of the ASA members have served their local chapters in one leadership capacity or another,” said 2011-12 ASA President Kerrick Whisenant, Cornerstone Detention Products Inc., Tanner, Ala. “So we know the level of commitment and the amount of time that’s involved in serving as a chapter committee chair, on the chapter board of directors or as a chapter officer.”

As 2010-11 president of ASA of Oklahoma, Gillmore did all that — and conducted staff searches, increased networking and professional opportunities, grew the chapter’s membership, and helped win subcontractor rights in the state legislature.

Description: DirectorCode Enforcement Seeking Volunteers



Development Services Department Code Enforcement Division is seeking resident volunteers for its Code Ranger and Graffiti Ranger programs.

The Code Ranger program provides opportunities for citizen volunteers to become involved with code enforcement activities. Code Rangers assist with such duties as removal and keeping inventory of bandit signs, identifying and reporting areas of illegal dumping and helping with community education and special events. The Graffiti Ranger program provides volunteers with an opportunity to proactively abate graffiti within their respective neighborhoods and throughout the city. Activities include: graffiti abatement, keeping inventory of graffiti, education outreach events at area schools, securing right of entry agreements and assisting with special projects. Volunteers of each program will have access to the use of city vehicles and equipment to assist in the completion of assignments.

Since December 2011 the Department has experienced a 403% increase in the number of zoning verification requests. As a result there has been an increase

in the length of staff review time, which is expected to continue through the months of February and March. Customers should know that all requests will be completed and the requestor will be notified if there are unusual circumstances that will result in a significant delay in issuing the requested letter. IB 176 - Plumbing Installation/Repairs Requiring Tunneling - the purpose of this Information Bulletin is to clarify the safety provisions regarding under-slab plumbing installations/repairs that may require tunneling to accomplish plumbing drain line repairs, replacements or re-routes. City Vendors who are interested in selling snow cones on Alamo Plaza will have the opportunity to participate in an annual lottery drawing process on Thursday, March 22, at 9:30 a.m. at the Central Library Auditorium, located at 600 Soledad. To participate in the lottery, vendors must complete an application and other necessary requirements. 

Vendors can obtain an application for the Downtown Operations Mobile Food Vending Program starting Wednesday, February 22. All vendors interested in participating in the lottery to sell snow cones on Alamo Plaza must apply. Applications will be available at the City of San Antonio's Downtown Operations Department, located at 400 N. St. Mary's St., Suite 100, Monday through Friday (except holidays) from 8 a.m. to 4 p.m. or accessed at http://www.sanantonio.gov/dtops/vending/default.aspx. Applications will only be accepted from Thursday, March 1 through Thursday, March 15 by 4 p.m.

Description: BlockSan Antonio Launches Better Block Project 

  

Spearheaded by the City's Planning and Community Development Department, community volunteers, local artists, architects and urbanists will transform the intersection of East Jones Ave. and Broadway Street into San Antonio's first Better Block on Sunday, March 4 from 10 a.m. to 2 p.m. The event is timed to occur during the City's second Siclovia, when Broadway will be closed between McCullough Ave. and Parland Street so that thousands of cyclists, runners, skaters and walkers of every age can enjoy a day of free, outdoor activities. They include pop-up retail shops such as ice cream shops and flower markets, two pop-up art galleries, street musicians, 24 trees, bike lanes and other street markings improving the roadway for pedestrians and cyclists.

The Better Block project is made possible with the help of Peerless Tree Farm and Milberger Nursery who will provide the landscaping, and dozens of volunteers to construct the scene, create art and music, and run the pop-up retail shops. Property owners in the area also agreed to lend their vacant spaces and contribute to bringing more street life to the area.

Organizers chose to introduce the Better Block initiative to San Antonio during the Siclovia in hopes of drawing more traffic to the Better Block site at East Jones and Broadway. The Better Block project is a demonstration of the City's Complete Streets initiative, which aims to enhance choice of mobility, facilitates physical activity and recreation and improves the quality of life, health and safety for all members of a community.

Be Aware of New State Laws Taking Effect on Jan. 1, 2012
Construction subcontractors should be aware of several major new state laws that take effect on Jan. 1, 2012, including:
  • California’s S.B. 293, signed into law (Chapter 700, Statutes of 2011) by Gov. Jerry Brown (D) on Oct. 9, 2011, which caps retainage at 5 percent on state and local public contracts entered into between Jan. 1, 2012, and Jan. 1, 2016. Because current state law prohibits a prime contractor from retaining more from a subcontractor than the owner retains from the prime, the law’s effect is a 5 percent cap on retainage that can be held on subcontractors. The new law improves the state’s prompt payment law by requiring upper-tier contractors on public projects to pay lower-tier contractors within seven days of receiving a progress payment. Previously, upper-tier contractors had 10 days to pay. The new law also exempts laborers from the state’s payment bond preliminary notice requirement.
  • Texas’ H.B. 2093, signed into law (Chapter 1292) by Gov. Rick Perry (R) on June 17, which dramatically limits the ability of other parties on a private or public construction project to transfer risk to subcontractors when subcontractors are not at fault. The law bans broad-form indemnity clauses in private and public construction contracts and mandates that “a consolidated insurance program that provides general liability insurance coverage must provide completed operations insurance coverage for a policy period of not less than three years.” The law also makes additional insured requirements in construction contracts “void and unenforceable,” except on consolidated insurance programs and for personal injury claims.
  • Texas’ H.B. 1456, also signed into law (Chapter 271) by Gov. Perry on June 17, which creates statutory lien waiver forms, both conditional and unconditional, for progress payments and final payment on construction projects. As a result, subcontractors and their clients will not have to manage an unpredictable patchwork of lien waiver forms.
  • Alabama’s H.B. 56, signed into law (Act No. 2011-535) by Gov. Robert Bentley (R) on June 9, which requires companies with state contracts to begin using the federal E-Verify system by Jan. 1, 2012, to confirm employees’ legal status to work. It also provides that companies will have their business licenses suspended after a first violation and permanently revoked after a second violation of the law.
Additionally, in Oregon, Gov. John Kitzhaber (D) on June 30, 2011, signed S.B. 384 into law (Chapter 553, 2011), making minor modifications to the billing cycle requirement for prompt payment of amounts due under private construction contracts. The law will take effect on Jan. 1, 2012.

Austin Commercial to Exhibit at ASA’s First-Ever GC Expo on March 1
Austin Commercial, Dallas, Texas, has joined a growing group of national and regional general contractors that will be on-hand on March 1 for subcontractors to meet during ASA’s first-ever GC Expo during the ASA Business Forum and Convention 2012 in San Antonio, Texas. ARCO Construction, Alberici Constructors, B.L. Harbert International and Clark Construction Group are among the general contractors that have already signed up to exhibit at the GC Expo from 4:30 p.m. to 7:00 p.m. at the Hyatt Regency San Antonio Riverwalk. ASA members will have exclusive access to the GC Expo between 4:30 p.m. and 5:30 p.m. At 6:00 p.m., the ASA President’s Reception, including an open bar, will take place inside the GC Expo room. NLRB Changes Union Election Procedures and Extends Poster Deadline to April 30
Two National Labor Relations Board decisions will change union election procedures and the date on which union and non-union firms covered by the National Labor Relations Act will have to inform employees of their rights to organize. On Dec. 21, the NLRB finalized its union election rule procedures, limiting testimony at regional hearings and consolidating appeals of regional director decisions into one post-election review request. The rule does not contain other provisions proposed by the board in June that would have set a pre-election hearing seven days after a union election petition is filed and would have given union officials access to workers’ e-mail addresses and phone numbers. The NLRB also extended the deadline for employers to display posters notifying employees of their right to organize from Jan. 31, 2012, to April 30, 2012. For more information, visit www.nlrb.gov.

New Federal Rule Will Redefine When Commercial Truck Drivers Are ‘On Duty’ and Limit ‘Work Week’
A new Federal Motor Carrier Safety Administration rule will affect construction subcontracting firms with commercial motor vehicles, beginning as early as February. The FMCSA rule revises, effective Feb. 27, 2012, the definition of when a driver is “on duty.” It also limits, beginning on July 1, 2013, the number of hours in a driver’s “work week.” Under the rule, the definition of “on duty” will include “all time loading or unloading a commercial motor vehicle, supervising, or assisting in the loading or unloading, attending a commercial motor vehicle being loaded or unloaded, remaining in readiness to operate the commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded.” The rule will also cap at 70 hours the maximum number of hours a truck driver can work within a week. Under the current rule, truck drivers can work up to 82 hours within a seven-day period. The new rule contains a “34-hour restart” provision, requiring drivers to “restart the clock on their work week by taking at least 34 consecutive hours off-duty.” The rule will not change the current daily driving limit of 11 hours. Commercial truck drivers who violate this rule could face civil penalties of up to $2,750 for each offense, and companies that allow their drivers to violate the new driving limits could face penalties of up to $11,000 for each offense. Surety Underwriters’ Outlook for Construction Markets Sours
Surety underwriters have a downbeat outlook for the recovery of construction markets, according to FMI’s second annual Survey of Surety Providers. Sixty-two percent of respondents said the U.S. nonresidential construction market will not experience growth until 2013, and 19 percent do not expect the recovery to occur until 2014. The results are in marked contrast to FMI’s 2010 survey results, according to which the majority of respondents expected the downturn to end by late 2010 or early 2011. Only 5 percent of 2011 respondents are confident that their client construction firms are “well-positioned,” with good exposure to stable or growing markets. Surety underwriters are concerned that firms are failing to reduce overhead costs and straying from core competencies. Fifty-seven percent of respondents expect their clients to have more difficulty in obtaining bonding one year from now, and 67 percent believe clients will have more difficulty obtaining a bond two years from now. “Surety providers look at three key factors when considering bonding applications: the expertise of the management team, the strength of the balance sheet and project history,” says Curt Young, vice president of FMI’s Investment Banking Group, which conducted the survey. “If a company is struggling financially, it is likely they have engaged in business practices that will have a detrimental impact on their long-term success.”

OPEN LETTER TO THE CONSTRUCTION INDUSTRY IN TEXAS

December 19, 2011

Dear Fellow Texan,
We have received a steady stream of phone calls over the past few weeks about a rumor circulating that VBX is closing its doors at the end of this year. Please be advised that this malicious story is wholly without merit - in other words, it's an outright lie.
Apparently, one of our competitors above the Mason-Dixon line is putting fierce pressure on our members and prospective members to subscribe to their service by the end of this year. We were entertained by these stories when they began to emerge, but that time is long past and we are no longer amused. We are now both saddened and appalled by this blatant attempt to discredit our organization and our services and we deeply regret any anxiety it has caused our subscribers.
This matter has been percolating for months now, as the time drew near for several of our Affiliate organizations to make decisions about whether or not to renew their relationship with us. We are pleased that three of our affiliates have renewed, but sorry to report that two organizations have elected not to do so - the San Antonio and West Texas Chapters of the Associated General Contractors of America. We retain the highest regard for both of these organizations and their members and hope there will be an opportunity to work with them again in the future.
The VBX Affiliate program was designed to attract new subscribers while helping local construction associations provide a tangible service for their members. Please be advised that VBX does not now, nor has it ever, relied solely upon its affiliates to supply the content of our service. Over the 112-year history of the Builders' Exchange, we have worked hard to build relationships with design firms and owners to ensure that our service is accurate and timely. In addition, we employ a large staff at three locations in Texas (San Antonio, Houston and Dallas) dedicated to making sure that we continue to remain the premier provider of construction bidding information in our state. Senate Passes 3 Percent Tax Withholding Repeal Legislation — ASA Urges Speedy Approval by House

Heeding appeals by ASA members from across the country, the U.S. Senate voted 95-0 (yeas-nays) in favor of H.R. 674, which would repeal the 3 percent tax withholding requirement on public contracts. Because senators attached a bi-partisan amendment to the legislation, the U.S. House of Representatives must pass the bill before it heads to the White House for signature. “ASA urges the U.S. House to quickly pass H.R. 674,” said 2011-12 ASA President Kerrick Whisenant, Cornerstone Detention Products Inc., Tanner, Ala. “President Obama should then sign the bill and finally repeal the burdensome 3 percent tax withholding requirement.” The Senate amendment provides tax credits to companies hiring unemployed veterans. Planning Commission application deadline extended to November 8, 2011
  

The City of San Antonio is seeking applicants to fill two available positions on the Planning Commission. The deadline to submit an application has been extended to Tuesday, Nov. 8, 2011.
 

The Planning Commission advises the City Council on the master plan for the physical development of San Antonio. It also provides recommendations on capital improvements and administers regulations on subdivisions and platting, to include the extra-territorial jurisdiction.
 

Regularly scheduled meetings are held twice a month on the second and fourth Wednesdays at 2 p.m. at the Cliff Morton Development and Business Services Center, 1901 S. Alamo St., in the first floor board room. Each term is two years.
