Be Aware of New State Laws Taking Effect on Jan. 1, 2012
Construction subcontractors should be aware of several major new state laws that take effect on Jan. 1, 2012, including:
  • California’s S.B. 293, signed into law (Chapter 700, Statutes of 2011) by Gov. Jerry Brown (D) on Oct. 9, 2011, which caps retainage at 5 percent on state and local public contracts entered into between Jan. 1, 2012, and Jan. 1, 2016. Because current state law prohibits a prime contractor from retaining more from a subcontractor than the owner retains from the prime, the law’s effect is a 5 percent cap on retainage that can be held on subcontractors. The new law improves the state’s prompt payment law by requiring upper-tier contractors on public projects to pay lower-tier contractors within seven days of receiving a progress payment. Previously, upper-tier contractors had 10 days to pay. The new law also exempts laborers from the state’s payment bond preliminary notice requirement.
  • Texas’ H.B. 2093, signed into law (Chapter 1292) by Gov. Rick Perry (R) on June 17, which dramatically limits the ability of other parties on a private or public construction project to transfer risk to subcontractors when subcontractors are not at fault. The law bans broad-form indemnity clauses in private and public construction contracts and mandates that “a consolidated insurance program that provides general liability insurance coverage must provide completed operations insurance coverage for a policy period of not less than three years.” The law also makes additional insured requirements in construction contracts “void and unenforceable,” except on consolidated insurance programs and for personal injury claims.
  • Texas’ H.B. 1456, also signed into law (Chapter 271) by Gov. Perry on June 17, which creates statutory lien waiver forms, both conditional and unconditional, for progress payments and final payment on construction projects. As a result, subcontractors and their clients will not have to manage an unpredictable patchwork of lien waiver forms.
  • Alabama’s H.B. 56, signed into law (Act No. 2011-535) by Gov. Robert Bentley (R) on June 9, which requires companies with state contracts to begin using the federal E-Verify system by Jan. 1, 2012, to confirm employees’ legal status to work. It also provides that companies will have their business licenses suspended after a first violation and permanently revoked after a second violation of the law.
Additionally, in Oregon, Gov. John Kitzhaber (D) on June 30, 2011, signed S.B. 384 into law (Chapter 553, 2011), making minor modifications to the billing cycle requirement for prompt payment of amounts due under private construction contracts. The law will take effect on Jan. 1, 2012.

Austin Commercial to Exhibit at ASA’s First-Ever GC Expo on March 1
Austin Commercial, Dallas, Texas, has joined a growing group of national and regional general contractors that will be on-hand on March 1 for subcontractors to meet during ASA’s first-ever GC Expo during the ASA Business Forum and Convention 2012 in San Antonio, Texas. ARCO Construction, Alberici Constructors, B.L. Harbert International and Clark Construction Group are among the general contractors that have already signed up to exhibit at the GC Expo from 4:30 p.m. to 7:00 p.m. at the Hyatt Regency San Antonio Riverwalk. ASA members will have exclusive access to the GC Expo between 4:30 p.m. and 5:30 p.m. At 6:00 p.m., the ASA President’s Reception, including an open bar, will take place inside the GC Expo room. NLRB Changes Union Election Procedures and Extends Poster Deadline to April 30
Two National Labor Relations Board decisions will change union election procedures and the date on which union and non-union firms covered by the National Labor Relations Act will have to inform employees of their rights to organize. On Dec. 21, the NLRB finalized its union election rule procedures, limiting testimony at regional hearings and consolidating appeals of regional director decisions into one post-election review request. The rule does not contain other provisions proposed by the board in June that would have set a pre-election hearing seven days after a union election petition is filed and would have given union officials access to workers’ e-mail addresses and phone numbers. The NLRB also extended the deadline for employers to display posters notifying employees of their right to organize from Jan. 31, 2012, to April 30, 2012. For more information, visit www.nlrb.gov.

New Federal Rule Will Redefine When Commercial Truck Drivers Are ‘On Duty’ and Limit ‘Work Week’
A new Federal Motor Carrier Safety Administration rule will affect construction subcontracting firms with commercial motor vehicles, beginning as early as February. The FMCSA rule revises, effective Feb. 27, 2012, the definition of when a driver is “on duty.” It also limits, beginning on July 1, 2013, the number of hours in a driver’s “work week.” Under the rule, the definition of “on duty” will include “all time loading or unloading a commercial motor vehicle, supervising, or assisting in the loading or unloading, attending a commercial motor vehicle being loaded or unloaded, remaining in readiness to operate the commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded.” The rule will also cap at 70 hours the maximum number of hours a truck driver can work within a week. Under the current rule, truck drivers can work up to 82 hours within a seven-day period. The new rule contains a “34-hour restart” provision, requiring drivers to “restart the clock on their work week by taking at least 34 consecutive hours off-duty.” The rule will not change the current daily driving limit of 11 hours. Commercial truck drivers who violate this rule could face civil penalties of up to $2,750 for each offense, and companies that allow their drivers to violate the new driving limits could face penalties of up to $11,000 for each offense. Surety Underwriters’ Outlook for Construction Markets Sours
Surety underwriters have a downbeat outlook for the recovery of construction markets, according to FMI’s second annual Survey of Surety Providers. Sixty-two percent of respondents said the U.S. nonresidential construction market will not experience growth until 2013, and 19 percent do not expect the recovery to occur until 2014. The results are in marked contrast to FMI’s 2010 survey results, according to which the majority of respondents expected the downturn to end by late 2010 or early 2011. Only 5 percent of 2011 respondents are confident that their client construction firms are “well-positioned,” with good exposure to stable or growing markets. Surety underwriters are concerned that firms are failing to reduce overhead costs and straying from core competencies. Fifty-seven percent of respondents expect their clients to have more difficulty in obtaining bonding one year from now, and 67 percent believe clients will have more difficulty obtaining a bond two years from now. “Surety providers look at three key factors when considering bonding applications: the expertise of the management team, the strength of the balance sheet and project history,” says Curt Young, vice president of FMI’s Investment Banking Group, which conducted the survey. “If a company is struggling financially, it is likely they have engaged in business practices that will have a detrimental impact on their long-term success.”

OPEN LETTER TO THE CONSTRUCTION INDUSTRY IN TEXAS

Dear Fellow Texan,
We have received a steady stream of phone calls over the past few weeks about a rumor circulating that VBX is closing its doors at the end of this year. Please be advised that this malicious story is wholly without merit - in other words, it's an outright lie.
Apparently, one of our competitors above the Mason-Dixon line is putting fierce pressure on our members and prospective members to subscribe to their service by the end of this year. We were entertained by these stories when they began to emerge, but that time is long past and we are no longer amused. We are now both saddened and appalled by this blatant attempt to discredit our organization and our services and we deeply regret any anxiety it has caused our subscribers.
This matter has been percolating for months now, as the time drew near for several of our Affiliate organizations to make decisions about whether or not to renew their relationship with us. We are pleased that three of our affiliates have renewed, but sorry to report that two organizations have elected not to do so - the San Antonio and West Texas Chapters of the Associated General Contractors of America. We retain the highest regard for both of these organizations and their members and hope there will be an opportunity to work with them again in the future.
The VBX Affiliate program was designed to attract new subscribers while helping local construction associations provide a tangible service for their members. Please be advised that VBX does not now, nor has it ever, relied solely upon its affiliates to supply the content of our service. Over the 112-year history of the Builders' Exchange, we have worked hard to build relationships with design firms and owners to ensure that our service is accurate and timely. In addition, we employ a large staff at three locations in Texas (San Antonio, Houston and Dallas) dedicated to making sure that we continue to remain the premier provider of construction bidding information in our state. Senate Passes 3 Percent Tax Withholding Repeal Legislation — ASA Urges Speedy Approval by House

Heeding appeals by ASA members from across the country, the U.S. Senate voted 95-0 (yeas-nays) in favor of H.R. 674, which would repeal the 3 percent tax withholding requirement on public contracts. Because senators attached a bi-partisan amendment to the legislation, the U.S. House of Representatives must pass the bill before it heads to the White House for signature. “ASA urges the U.S. House to quickly pass H.R. 674,” said 2011-12 ASA President Kerrick Whisenant, Cornerstone Detention Products Inc., Tanner, Ala. “President Obama should then sign the bill and finally repeal the burdensome 3 percent tax withholding requirement.” The Senate amendment provides tax credits to companies hiring unemployed veterans. Planning Commission application deadline extended to November 8, 2011
  

The City of San Antonio is seeking applicants to fill two available positions on the Planning Commission. The deadline to submit an application has been extended to Tuesday, Nov. 8, 2011.
 

The Planning Commission advises the City Council on the master plan for the physical development of San Antonio. It also provides recommendations on capital improvements and administers regulations on subdivisions and platting, to include the extra-territorial jurisdiction.
 

Regularly scheduled meetings are held twice a month on the second and fourth Wednesdays at 2 p.m. at the Cliff Morton Development and Business Services Center, 1901 S. Alamo St., in the first floor board room. Each term is two years.
